There are new rights for women taking maternity or adoption leave.
There are two different types of maternity leave. The first 26 weeks is called Ordinary Maternity Leave (OML). You can also take an additional 26 weeks' maternity leave, called Additional Maternity Leave (AML), giving you a total of up to 52 weeks’ maternity leave.
If your expected week of childbirth is on or after 5 October and you take AML on top of OML, you now have the right to keep all the terms and conditions of your employment contract. The one exception is that you won't get your normal pay, unless your contract allows for it.
Women with an expected childbirth date before 5 October only have the right to keep all the terms and conditions of their employment contract during OML. They will keep some of these rights during AML but not all of them.
The same rights also apply to parents taking adoption leave.
